BIMCO - New Hull Fouling Clause for Time Charter Parties

If, due to charterers’ orders, a vessel sits at anchor awaiting a berth for an extended period or spends a prolonged length of time alongside working cargo, particularly in tropical waters, there is a strong likelihood that marine growth will form on the hull and subsequently affect the vessel’s performance.

In order to protect shipowners’ interests, BIMCO has published a new clause for time charter parties to address this particular issue. Further details including the text of the clause can be found in BIMCO’s Hull Fouling Clause for Time Charter Parties.

Members negotiating new time charter parties may wish to incorporate this clause into the terms.
